Student visa family changes 2026 are a major part of Tony Burke's completed National Press Club migration announcement on 17 September 2026.

Australia has announced a major restriction on Student visa dependants. Most international students will no longer be able to bring spouses, partners and children to Australia in the same way under the Subclass 500 program.
What did Tony Burke confirm?
Burke confirmed that the government will restrict family accompaniment for most international students. He also identified important exceptions, including PhD students and students from ASEAN and Pacific countries.
For Nepali nationals, the regional exception is particularly important to understand. Nepal is not an ASEAN member state and is not a Pacific island country. A Nepali student therefore should not assume they fall within those regional exceptions. A Nepali PhD student may fall within the announced PhD exception, subject to the final regulations.

What has not yet been confirmed in law?
The speech confirms the government's policy, but the precise legal amendment still matters. At the time of this update, the final regulations and all transitional provisions were not yet available in a form that allows every case to be answered.
The exact commencement date still needs to be confirmed from the amending instrument.
The treatment of combined Student visa applications already lodged but not decided requires the transition rules.
The treatment of later 'subsequent entrant' applications by spouses or children requires the final drafting.
The position of family members who already hold granted Student visas should be checked separately from future applications.
Any additional exemptions beyond the announced PhD and ASEAN/Pacific groups need to be verified from the final instrument.
Who is likely to be most affected?
Nepali students who have not yet lodged
A student planning to study in Australia with a spouse or children should now reassess the entire family strategy before paying substantial tuition, arranging travel or making employment and schooling decisions.
Nepali students already in Australia who planned to bring family later
This group may be particularly exposed if later secondary or subsequent-entrant applications are restricted. The final commencement and saving provisions will determine whether a planned application remains available.
Nepali PhD students
The speech identified PhD students as an exception. This is potentially significant for Nepali doctoral candidates and their families. However, applicants should wait for the final legal drafting before assuming every doctoral course or every family member is automatically covered.
Existing dependant visa holders
The announcement does not automatically cancel an existing valid visa. A family member who already holds a visa must comply with that visa's actual conditions. Any future change affecting existing grants would require a lawful basis.
The change is part of a wider anti-visa-hopping strategy
The student-family restriction sits alongside measures designed to reduce repeated temporary stays. The government is also targeting course changes and temporary visa extensions used primarily to prolong a person's stay rather than pursue a genuine study objective.
Australia had already stopped Visitor visa holders and Temporary Graduate visa holders from applying for a Student visa onshore from 1 July 2024. Today's announcement continues that direction of travel.

What should Nepali students do now?
Do not omit a spouse or child from an application merely to avoid the new rule; incorrect family declarations can create serious future issues.
If you are planning a spouse or child application soon, check the commencement and transition rules before lodging.
Keep copies of all previous visa applications, family declarations, marriage certificates, birth certificates and relationship evidence.
If you are a PhD applicant, confirm whether your course and family member fit the final exception once the regulations are published.
Do not assume a media report about a 'ban' answers your individual application-validity question.
