Australian Property Settlement When You Own Property in Nepal

For many Nepali couples in Australia, the property pool does not stop at the Australian border. A family may own a home in Melbourne and also have land in Kathmandu, ancestral property in a village, bank accounts in Nepal, interests in a family business or property held jointly with relatives.


Does Australian family law consider property in Nepal?

Australian property settlement proceedings can require the parties to identify and disclose their property and financial resources. The Family Law Act 1975 gives the Court power to alter property interests between parties, and the Court’s financial procedures require full and frank disclosure of relevant financial circumstances.


What kinds of Nepal assets may be relevant?

Relevant assets may include land, houses, apartments, bank accounts, company interests, loans, investments and other property interests in Nepal. An inheritance or ancestral-property interest can also be relevant, although its treatment depends on the facts, timing, contributions and the current legal nature of the interest.


You still have a duty of disclosure

A party should not omit an asset simply because it is located in Nepal or registered through a Nepalese document. The Court’s balance-sheet process expects current assets and liabilities to be identified and supported by financial documents where available.


How is Nepal property valued?

The parties may agree on a value or obtain evidence from an appropriately qualified valuer. Difficulties can arise where title records, local market values, co-ownership arrangements or family claims are disputed. Currency conversion also needs to be handled consistently.


Can an Australian court directly transfer Nepalese land?

Cross-border enforcement requires care. Australian property orders bind the parties, but implementing a transaction involving Nepalese land may also require compliance with Nepalese property, registration and citizenship laws. In practice, coordinated Australian and Nepalese legal advice may be required before final orders are drafted.
